The charges, and consequently the possible sentences, under this category vary greatly. If a person with a felony conviction is near a gun that is not clearly possessed by another, he or she is often at risk of being charged with the offense of Felon in Possession of a Firearm. There are two types of possession:
a) Actual Possession - an item is in the hand or on the person, and
b) Constructive Possession - an item is not in the hand or on the person but is tied to the individual in such a way so as to allow the reasonable inference that the person knows of the existence/location of the item, knows of its illicit nature and, by all other indicators, has the ability to exercise dominion and control over the item.
